Posting of workers within the EU is causing institutional change in national employment relations. Posting companies can use EU law to be exempted from or reinterpret the ordinary functioning of national employment relations institutions. This often results in inferior working conditions for posted workers. However, the creation of new formal institutions (layering) and enforcement actors´ development of new everyday practices (creative re-enactment) counteracts a total erosion of institutionalized labor standards. This presentation will elaborate on this argument and give empirical illustrations.
